Who can use SwapMyList

To use SwapMyList, you must:

• Be at least 18 years old.
• Provide accurate and truthful information in your profile.
• Have the legal right to send emails to the lists you represent.
• Comply with all applicable laws, including anti-spam regulations like CAN-SPAM, GDPR, and CASL.

We reserve the right to suspend or remove accounts that violate these requirements.

Your responsibilities

When you use SwapMyList, you agree to:

• Be honest. Accurately represent your subscriber count, niche, engagement rates, and any other profile information. Do not inflate numbers or mislead potential partners.
• Get consent. Only swap or cross-promote with lists where subscribers have given proper consent to receive communications. Do not use purchased, scraped, or non-consented lists.
• Honor your agreements. If you commit to a list swap with another member, follow through in good faith and on time.
• Be respectful. Treat other members professionally. Harassment, abusive language, or unethical behavior will result in account removal.
• Keep your account secure. Do not share your login credentials. You are responsible for anything that happens under your account.

What SwapMyList does and does not do

SwapMyList is a matching platform, not a guarantee. We help you find potential partners, but we do not:

• Verify every claim made by users in their profiles (though we encourage honesty and may remove misleading listings).
• Manage or execute the actual email sends on your behalf.
• Guarantee specific results (such as a certain number of new subscribers).
• Take responsibility for the content of emails sent by you or your partners.

Any list swap arrangement is a direct agreement between you and your partner. SwapMyList is not a party to those agreements.

Content you post

You keep ownership of any content you post on SwapMyList (such as your profile description or newsletter details). By posting it, you give us permission to display it on the site so other members can find and contact you.

Do not post content that is illegal, hateful, fraudulent, or infringing on others' rights. We may remove content that violates these rules.

Prohibited activities

You may not use SwapMyList to:

• Spam, phish, or send unsolicited emails.
• Scrape, harvest, or collect other users' contact information without permission.
• Impersonate another person or organization.
• Upload malware, viruses, or harmful code.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Use automated scripts or bots to interact with the site in ways that abuse the service.

Account termination

We may suspend or terminate your account if you violate these terms, abuse the platform, or engage in behavior that harms other members or the service. We will generally try to warn you first, but we reserve the right to act immediately in cases of serious abuse.

You can also delete your own account at any time from your profile settings.

Limitation of liability

SwapMyList is provided "as is." To the fullest extent allowed by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability to you for any claim will not exceed the amount you have paid us in the 12 months before the claim (or $50 if you have a free account).

Nothing in these terms limits liability for fraud, gross negligence, or anything that cannot legally be excluded in your jurisdiction.

Changes to these terms

We may update these Terms of Service from time to time. If we make significant changes, we will notify you by email or through a notice on the site. Continued use of SwapMyList after changes means you accept the updated terms.

Governing law

These terms are governed by the laws of the jurisdiction where SwapMyList operates, without regard to conflict-of-law principles.
